• Infringe trademark rights of yours or any third party or otherwise violate the rights of any third party


• Contain sexually explicit materials


• Contain hate/violent/offensive content


• Promote discrimination based on race, sex, religion, nationality, disability,
• sexual orientation, or age


• Promote illegal activities or otherwise violate any applicable laws, including those targeting “spyware,” “adware” or SPAM


• Violate any intellectual property rights, including, without limitation, scraping text or images from the ThemeMatic.com Website


• Do not clearly state an online privacy policy to its visitors


• Otherwise are considered offensive or inappropriate at ThemeMatic.com’s sole discretion

This agreement governs participation in the ThemeMatic.com Affiliate Program only.
Once you are accepted into the Program, you will be able to participate in the Program subject to the terms and conditions of this Agreement. You should also note that if you are accepted to participate in the Program and your Site is thereafter determined (in our sole discretion) to be unsuitable based on the criteria above for the Program, we may terminate this Agreement.

Affiliate Program Terms of Service Agreement
The individual applying to become an affiliate clearly agrees that he/she has completely read and understood and agrees to the entire agreement and agrees to comply with all terms and conditions stated within.

You agree and certify that you are of legal age in the state of your residence that you are legally able to bear this contract. You also agree that the taxpayer ID you have given us is valid and that all contact information is current and true. Affiliates are also responsible for keeping the contact information current.

Once ThemeMatic.com accepts this agreement, it will become binding to both parties. Once this agreement becomes binding, you will become an affiliate and in no way will you be considered or deemed as an employee of ThemeMatic.com.

No laws pertaining to employees shall be applicable to any affiliate of ThemeMatic.com. We will not be responsible for any taxes or contributions or any other laws pertaining to employees.

Employees of ThemeMatic.com are not eligible to participate in this affiliate program. 

No purchase is necessary to become an affiliate of ThemeMatic.com, however commissions are paid on the sale of product only.

ThemeMatic.com agrees to pay a $30.00 commission to the affiliate after each fully paid qualified product sale made by a customer referred by the affiliate. A customer is considered to be “referred by the affiliate” if the customer clicked a banner or link on the affiliate’s web site and has a cookie, which ThemeMatic.com will attempt to place on their computer, to confirm this. Commissions will by paid via PayPal.You may NOT sell to yourself. Selling to yourself includes but is not limited to ordering product directly after clicking on your own affiliate banner or link, paying for an order other than your own, placing your contact information on someone else's order form, etc. In other words, you may not sign up as an affiliate and then purchase product via your own link. If you are caught selling to yourself, your affiliate status will be terminated and you will forfeit any commission. Sales deemed as 'sold to yourself' are not considered to be 'fully paid qualified product sales' and we will NOT pay any commission on any of these types of sales.

There is never a guarantee of income or other earnings either verbal, written, or implied. All earnings are always based solely on the individual efforts of each and every affiliate.

Affiliates will ONLY be paid on 'fully paid qualified product sales' and will not be paid on ANY other sales generated via affiliate referral or link, etc. A 'fully paid qualified product sale' is a first time purchase by an individual and/or business of product(s) from ThemeMatic.com. Affiliates will NOT be paid on ANY AND ALL 'Add-On' sales including but not limited to affiliate programs of which ThemeMatic.com may be a participant, etc.  Affiliates will NOT be paid for the sale of any product other than a products offered for sale on the ThemeMatic.com website.

Affiliates are responsible for filing and paying all personal and business income taxes including state, local and federal taxes owed because of bonuses or payments made to you in connection with this program.

Affiliates must represent ThemeMatic.com in a lawful and ethical manner. You must stress the product and not the opportunity. You must only claim or represent what we have as a company provided to you. Any claims by an affiliate that do not reflect what has already been printed or deemed fit by the company will be declared possibly untrue and inaccurate.

Affiliates must treat us with respect. Any attempts to abuse, undermine, slander, libel, threaten, swear at, or cause harm to ThemeMatic.com, one of its customers, employees, or the company directly is strictly prohibited and is grounds for immediate affiliate account termination. In addition, we will pursue all attempts to the fullest extent of the law.

You may only advertise in ways stated and provided by ThemeMatic.com. Any use of logos or any other copyrighted material is strictly prohibited. You may not make false representations or claims about our services or compensation plan.

You are not allowed to advertise us with any illegal methods, including but not limited to: spamming, Usenet Spamming, Unsolicited Email, Mail Spamming, BBS Spamming, and any other type of spam.

The affiliate may cancel their participation in this program at any time for any reason through our affiliate control panel.

This agreement may be terminated or suspended if a breach of this contract is discovered, or at the sole discretion of ThemeMatic.com. Affiliates found to have violated any or all of the terms herein will forfeit any and all commission, and affiliate status will be terminated.

ThemeMatic.com reserves the right to modify, change, edit, or update the Terms of Service Agreement at any time. ThemeMatic.com is the sole arbiter regarding affiliate referral disputes and affiliate payments.
